The State Service has adopted a decision on the regulation of railway activity

Decision on the case brought by the State Service for Antimonopoly and Consumer Market Control under the Ministry of Economy against "Azerbaijan Railways" CJSC (hereinafter - the Company) on the signs of violation of competition related to the leasing of wagons (fixed assets), railway transportation, as well as the application of tariffs and concessions accepted.

During the review of the case, a violation of competition principles was determined by the Company by creating obstacles to the activities of private companies, accepting orders for freight transportation services by railways, carrying out cargo transportation, leasing wagons, setting tariffs and discounts.

According to the decision, the suspension of forwarding activities of the Company's subsidiaries and the execution of orders in the field of cargo transportation, the provision of competitive and transparent leasing of wagons at real prices for a short period of time, the condition of maintaining healthy competition principles without creating discrimination between business subjects on the types of cargo transported, concessions and tariffs The Company was instructed to determine in a uniform, transparent, accessible and predictable form, to apply tariff concessions not to entities, but to transported loads, and for this purpose, to approve the list of loads to which the concession is applied, and specific dates for its implementation were determined.

Also, in the instruction, drafts of documents regulating relations between shippers, carriers and forwarders were prepared and presented accordingly, an electronic platform was put into use to ensure easier access to services by business entities. It is also intended to prepare and submit relevant proposals to the State Service for more efficient use of passenger carriages, taking into account the needs of consumers in passenger transportation activities.

In the decision, the demands on "Azerbaijan Railways" CJSC to take appropriate steps in the direction of improving the natural monopoly activity, competition in the field of cargo transportation services, as well as ensuring the rights and interests of consumers and business entities were also reflected.
