An opinion from the State Agency for Antimonopoly and Consumer Market Control under the President of the Republic of Azerbaijan is required for the relevant executive authority to issue a licence for operating fuel filling stations.
The State Agency for Antimonopoly and Consumer Market Control under the President of the Republic of Azerbaijan issues the following notice to business entities operating fuel filling stations.
Under legislative requirements, obtaining an opinion from the State Agency for Antimonopoly and Consumer Market Control under the President of the Republic of Azerbaijan is among the additional requirements for obtaining a licence to operate fuel filling stations. Accordingly, for a licence to be issued, the Agency must issue an opinion confirming that the measuring instruments used at such stations comply with the requirements of the Law of the Republic of Azerbaijan “On Ensuring the Uniformity of Measurements” and, for goods covered by technical regulations, the Law of the Republic of Azerbaijan “On Technical Regulation”. To this end, the types of measuring instruments installed at fuel filling stations must be approved and the instruments must undergo the relevant verification; the conformity of goods covered by technical regulations must be assessed; and the relevant supporting documents, including certificates, verification certificates, inspection reports and others, must be obtained.
To obtain the opinion, business entities operating fuel filling stations must submit an application to the Agency on the prescribed form, regardless of whether the equipment and installations required for operating the station, including measuring instruments, have been newly installed and not yet commissioned or are already in operation. Applications may be submitted to the Agency in person or through an authorized representative, via its official website or by email.
Before submitting an application, the applicant must check in the Agency’s state register whether information on the type approval of the measuring instruments installed at the fuel filling station is available. The applicant must then attach to the application the documents issued by accredited conformity assessment bodies for the relevant goods, including equipment, installations, measuring instruments and other items.
Information on the accredited conformity assessment bodies authorized to issue the required documents is available on the official website of the Azerbaijan Accreditation Centre operating under the Agency.
