Consumer market control

One of the main activities of the State Service is the protection of consumer rights and control over the consumer market. The State Service for Antimonopoly and Consumer Market Control is entrusted the duty of ensuring consumer rights and their protection by the state, by the Law of the Republic of Azerbaijan “On Protection of Consumer Rights” adopted in 1995 as well as other sectoral laws and its regulations based on the duties and rights: 

  1. monitors compliance with the legislation on consumer protection in the consumer market, norms and rules of trade, catering, household and other services;

  2. expired, prohibited, counterfeit, unknown origin, unusable, does not meet the requirements of standards and other normative documents, must be certified in accordance with the legislation, but not certified, dangerous to human life, health, property or the environment (works) , services), take measures to suspend the sale (execution) of consignments of goods, withdraw from circulation (sale) and bring to justice the perpetrators in accordance with the law;

  3. considers consumers' appeals on deception of consumers by weight (size), price, calculations, failure to provide consumers with complete and correct information on goods, violation of terms of sale and takes measures in accordance with the legislation;

  4. Controls the observance of the neighborhood and temperature regime during storage or sale of goods, except for food products, as well as goods under veterinary and phytosanitary control.

  5. Monitors price discipline, including the observance of price discipline in the provision of goods (works, services) whose prices are regulated by the state and the correct application of prices.

The main task of the State Service in this area is to provide consumers with quality and safe goods (works and services), to prevent violations of their rights when selling goods, doing work and providing services, and to restore violated rights.

In this regard, the State Service conducts monitoring and inspections in the consumer market. Carries out research and studies on the basis of information obtained from monitoring, inspections, as well as market entities, takes appropriate measures to eliminate the identified violations, to take legal action against legal entities and individuals who have violated the law.

The State Service also reviews complaints from consumers, investigates cases of violations of consumer rights by entrepreneurs and takes measures to eliminate such cases.

The activity of the State Service in the field of protection of the rights of consumers and control of the consumer market is mainly based on the following legislative acts and normative documents:
