Public Procurement

One of the directions of the activity of the State Service for Antimonopoly and Consumer Market Control under the Ministry of Economy of the Republic of Azerbaijan in accordance with the Regulations approved by the Decree of the President of the Republic of Azerbaijan No. 1017 dated May 12, 2020, is to participate in the implementation of state policy in the field of procurement of goods (works and services) at the expense of state funds regulated by the Law of the Republic of Azerbaijan “On Public Procurement” together with relevant state bodies, to ensure state control in this field. This duties were and functions were previously performed by the State Procurement Agency of the Republic of Azerbaijan were annulled by the Decree of the President of the Republic of Azerbaijan No. 741 dated 15, 2016 and were transferred to State Service.

Law of the Republic of Azerbaijan “On Public Procurement” State enterprises and organizations (departments) in the Republic of Azerbaijan determines the economic, legal and organizational basis for the procurement of goods (works and services) by enterprises and organizations with a state share of 30 percent or more in the authorized fund at the expense of state funds, loans and grants received by the state and guaranteed by the state; the establishment of the principles and rules for the efficient and cost effective use of public funds in procurement; the creation of an equal competitive environment for all providers (contractors) based on competition and transparency.

History of the Law of the Republic of Azerbaijan “On Public Procurement”

  • "Regulations on procurement of goods (works and services) by budget organizations" approved by the Decree of the President of the Republic of Azerbaijan No. 524 dated December 19, 1996
  • The Law of the Republic of Azerbaijan “On Tender” No. 247-IQ of February 11, 1997 entered into force by the Decree of the President of the Republic of Azerbaijan No. 570 of April 7, 1997
  • The Law of the Republic of Azerbaijan “On Public Procurement” No. 245-IIQ of December 27, 2001 entered into force by the Decree of the President of the Republic of Azerbaijan No. 668 of January 29, 2002 (amended 28.05.20) and repealed the Law of the Republic of Azerbaijan “On Tender” . The current Law has been amended 12 times on different dates (22.11.02, 21.10.05, 20.10.06, 12.02.10, 05.03.10, 19.01.16, 04.03.16, 07.04.17, 28.12.18, 09.07.19, 12.07 .19 and 01.05.20)
